  2. Drawing up technical and boundary plans.
  3. Organization of land management examination.
  4. Drawing up general documentation of the analyzed land plots (Acts on the survey of lands and the removal of the boundaries of their territory).

In the modern world, this specialty is gaining increasing popularity. The demand for cadastral engineering specialists has increased several times. That is why universities and colleges are recruiting an increasing number of students for this specialty.

4 years after the adoption of the above law, namely from January 1, 2011, its provision came into effect that cadastral activities in relation to plots of land have the right to be carried out exclusively by cadastral engineers, moreover, with a certificate (valid) confirming their qualifications as specialists. Currently, more than 30 thousand cadastral engineers are certified. Data about them is contained in the state register of relevant specialists. What does "certified" mean? By this term the following should be understood: the performers have passed the qualification exam, have a qualification certificate in hand and can legally carry out cadastral work on the territory of Russia.



The ranks of the above-mentioned SRO NP “Cadastral Engineers” currently include more than 4,000 cadastral engineers from most Russian regions. But this is not the only organization of this kind: in 2012, the National Association of Self-Regulatory Organizations in the Field of Cadastral Activities arose and began its operation. This association has taken under its wing 11 SROs operating on the territory of the Russian Federation.

The new profession imposes great responsibility on the person: he is individually responsible for the errors he makes in calculations, measurements and documentation. As a result, the result of the work done is of high quality - much higher than that of land managers.


The services provided by cadastral engineers to the population of Russia are very popular among, as mentioned at the beginning of this article, owners of private real estate and land plots. Of course, in principle, they are forced to invite a cadastral engineer to perform a certain list of specific works, because this is prescribed by law. However, in some cases, the activities of people in the profession we are considering turn out to be very useful, for example, when:

  • purchase and sale;
  • registration of inheritance;
  • resolving conflicts with neighbors, especially over land boundaries;
  • confirmation of the right to build a house on a specific site;
  • consolidation/division of property plots, etc.

How does a cadastral engineer work? It can be divided into several stages. The first stage is characterized by his initiation of checking the documents of the owners of the home/plot of land to see if they have everything on hand. Then he carries out a thorough technical inspection of the territory owned by the owners, using specific technical means. At the end of this process, the third stage begins, when the certified executor of cadastral works coordinates all the measurements he has made with the neighbors of the person who turned to him for services. When this part of the activity is completed, the cadastral engineer installs all the necessary boundary signs, draws the required plans and, at the same time, prepares a package of documents for submission to the state accounting authorities. The cadastral work executor is also responsible for advising clients on land management issues. Among other things, he can resolve conflict situations between clients.

A cadastral engineer either acts as an individual entrepreneur or is an employee of some standard company providing legal or real estate services. The activities of the cadastral work executor are not tied to any one place. A person who has mastered this profession and occupied the corresponding position should be prepared for constant movement and business trips. It’s great if the cadastral engineer has a driver’s license and his own car.

From January 1, 2017, new rules for registering rights to real estate appeared. They simplify the registration process

On January 1, 2017, the Federal Law of July 13, 2015 No. 218-FZ “On State Registration of Real Estate” (hereinafter referred to as Law No. 218-FZ) came into force. It repeals Federal Law No. 122-FZ of July 21, 1997 “On state registration of rights to real estate and transactions with it” (hereinafter referred to as Law No. 122-FZ). Let's look at 9 changes that will simplify the registration of rights to real estate.

New basis for registering rights to real estate

All grounds for registering rights that were specified in Article 17 of Law No. 122-FZ are also contained in Article 14 of Law No. 218-FZ.

On January 1, 2017, a new basis appeared - the occurrence of circumstances specified in the federal law (clause 9, part 2, article 14 of Law No. 218-FZ). We are talking about rights to real estate that arise by force of law:

due to circumstances specified in the law,

· not from the date of state registration of rights.

Such rights are legally valid even without state registration in the Unified State Register of Real Estate.

Rosreestr registers them in the Unified State Register of Real Estate:

· according to statements of copyright holders;

· the decision of the registrar upon receipt of information from government authorities and notaries that confirm the occurrence of such rights, except in cases established by federal laws (Part 2 of Article 69 of Law No. 218-FZ).

Who can apply for registration of real estate rights

Law No. 218-FZ does not contain fundamentally new rules and regulations that would change the composition of persons with the right to apply for registration of rights (cadastral registration). The difference is this.

All persons upon whose application registration is carried out are now listed in one article of Law No. 218-FZ - article 15 “Persons upon whose application state cadastral registration and state registration of rights are carried out”:

· in part 1 – persons, upon whose application Rosreestr simultaneously carries out both state cadastral registration and registration of rights;

· in part 2 – persons, upon whose application Rosreestr carries out only state cadastral registration without simultaneous registration of rights;

· in part 3 – persons, upon whose application Rosreestr carries out registration of rights without simultaneous state cadastral registration.

Previously, persons upon whose application Rosreestr carried out registration were listed in various articles of Law No. 122-FZ.

Rosreestr will request constituent documents from the tax office

Law No. 218-FZ will simplify the procedure for collecting additional documents for registration of rights, which the applicant must submit to Rosreestr in addition to the main documents in relation to the property and the rights to it.

Previously, Rosreestr itself only requested an extract from the Unified State Register of Legal Entities in relation to the applicant (paragraph 9, paragraph 2, article 16 of Law No. 122-FZ). In addition, constituent documents (or their notarized copies) could not be submitted to Rosreestr only in two cases:

· if the constituent documents have already been submitted and the legal entity’s right to the corresponding property has been registered,

· if, from the moment of registration of the legal entity’s rights, the tax office has not registered changes in its constituent documents.

In all other cases, the applicant had to submit these documents to Rosreestr independently.

Law No. 218-FZ obligated Rosreestr to independently request the applicant’s constituent documents from the tax authority (Part 9, Article 18 of Law No. 218-FZ). In this case, it does not matter whether the applicant for registration of rights previously submitted them and whether they made changes to them.

Requirements for documents for registration of rights

Most of the requirements for documents submitted for registration in Law No. 218-FZ remained unchanged. However, as of January 1, 2017, some requirements will change.

Only one original needs to be submitted for registration (Part 3, Article 21 of Law No. 218-FZ). Simplification applies to paper documents that:

express the contents of the transaction and

· serve as the basis for registering the existence, origin, termination, transfer, restriction of rights and encumbrances of real estate.

The applicant submits them for registration:

· in at least two original copies, one of which is returned to the copyright holder, the second is placed in the registry file - if the transaction is made in simple written form;

· in at least two copies, one of which (the original) is returned to the copyright holder - if the transaction was made in notarial form or the right on the basis of the transaction arose before the entry into force of Law No. 122-FZ.

Previously, it was necessary to submit for registration (Part 5 of Article 18 of Law No. 122-FZ):

· two original copies, one of which, after registration of rights, was returned to the copyright holder, the second was placed in the file of title documents, if the transaction was made in simple written form;

· two copies, one of which (the original) was returned to the copyright holder after registration of the rights - if the right based on the transaction arose before the entry into force of Law No. 122-FZ.

It is necessary to submit copies (not originals) of acts of government agencies and the court (Part 5 of Article 21 of Law No. 218-FZ). The applicant submits for registration one copy of the following:

· acts of public authorities,

· acts of local government bodies,

· judicial acts that establish rights to real estate.

Rosreestr scans them and returns them to the applicant after registration.

Documents for registration of real estate rights can be submitted from anywhere in the world

Regardless of the location of the property, you can:

· send documents by mail or

· Contact Rosreestr or MFC.

Part 2 of Article 18 of Law No. 218-FZ directly states: “... documents... on paper through personal appeal are presented regardless of the location of the property...”.

This rule applies to the application (and documents attached to it):

· on state cadastral registration and (or)

· registration of rights.

The applicant can:

· submit documents in person to the Rosreestr department or to the MFC according to the list published on the official website;

· Send paper documents by mail.

Documents can be submitted through the field office of Rosreestr

An important innovation is the registration of rights during on-site acceptance of documents by Rosreestr employees. In this case, the applicant submits the application and the documents attached to it in the form of documents on paper, personally contacting an authorized person of Rosreestr (Clause 1, Part 1, Article 18 of Law No. 218-FZ).

Rosreestr published on the official website a list of departments that are engaged in on-site reception (paragraph 3, sub. 1, clause 2 of the Procedure for submitting an application for state cadastral registration of real estate and (or) state registration of rights to real estate and documents attached to it, approved by order of the Ministry of Economic Development Russia dated November 26, 2015 No. 883).

Government agencies themselves will transfer documents to Rosreestr

The registration procedure will be simplified if the right arises on the basis of:

· act of a government body,

· act of the local government body,

· agreements or contracts with a state authority or local government.

According to the previously existing procedure, if the right arose on the basis of:

· an act of a state body or an act of a local government body, then the application for registration was submitted by the person in respect of whom these acts were adopted;

· agreement or agreement with a state authority or local government body, then the application was submitted by both these authorities and the person who entered into the agreement or agreement (Part 1 of Article 16 of Law No. 122-FZ).

Law No. 218-FZ establishes a fundamentally new registration procedure (Part 2, Article 19). The state body (or local government body) is obliged to send documents for registration to Rosreestr no later than five working days:

1. From the date when the act is adopted, according to which the following arises:

· right,

· restriction of rights,

· encumbrance of the property.

2. From the date when a transaction in relation to real estate was completed (including a transaction that was completed on the basis of an act of a state authority or local government body).

Rosreestr will be obliged to notify about the application for registration of rights

Rosreestr is obliged to notify the copyright holder that an application for registration of rights has been received in relation to his real estate. He must do this on the day the application is received, provided that information about the property is in the Unified State Register of Real Estate.

For this purpose, the Ministry of Economic Development of Russia has approved the Procedure for notifying the registration authority of the rights of the copyright holder about the receipt of an application for state registration of rights to a real estate property, information about which is contained in the Unified State Register of Real Estate (order dated March 15, 2016 No. 127).

Until 2017, Rosreestr was required to notify the copyright holder of real estate within five working days only upon state registration:

· restrictions (encumbrances) of rights established in accordance with legislation in the public interest by state authorities and local government bodies on the initiative of these bodies, or

· restrictions (encumbrances) of ownership and other real rights by the rights of third parties (paragraph 2, part 2, article 13 of Law No. 122-FZ).

The period for registering rights to real estate will be reduced

Previously, as a general rule, registration of rights was carried out within 10 working days from the date of receipt of the application and documents (Part 3 of Article 13 of Law No. 122-FZ).

Exception – state registration:

· mortgage of land plots, buildings, structures, non-residential premises (carried out no later than 15 working days);

· residential mortgages (carried out no later than five working days);

· on the basis of notarized documents (carried out no later than three working days);

· on the basis of notarized documents presented in the form of electronic documents, electronic images of documents and an application for state registration of rights submitted by a notary in electronic form (carried out no later than one business day).

Since 2017, a fundamentally new approach to the timing of registration actions (Article 16 of Law No. 218-FZ).
